Kate Gosselin's ouster from Dancing with the Star will not allow her to duck ex Jon Gosselin's 'absentee mother' lawsuit against her.

Jon Gosselin filed a motion on April 7 seeking full custody of their children and child support from Kate.

In his court filing, List called Kate "an absentee mom" citing her participation in the current season of DWTS, which requires her to be away in Los Angeles leaving the children behind in Pennsylvania with nannies.

Due to high ratings from both Discovery Health specials, the network signed Kate Gosselin and her family to their own reality TV show entitled “Jon & Kate Plus 8.” The show, which is filmed three to four days a week, was first aired in April 2007. After two seasons with Discovery Health channel, “Jon & Kate Plus 8” moved to TLC. "'Dancing with the Stars' is just the tip of the iceberg for Kate, as surely there will be many other projects to take its place soon," he said.
